These terms set out the rules for using FetchExpress, the responsibilities of customers, riders, and merchants, how payments and cash on delivery work, and the limits of our liability. By creating an account or using the service, you agree to these terms.
The agreement in detail
Who these terms are between
FetchExpress is operated by GapLinker, Inc. ("FetchExpress", "we", "us"). These terms form an agreement between you and us. They apply to everyone who uses the service: customers who post fetches, riders who fulfill them, and merchants who list with us. Where a community hub operates locally, that hub may set additional rules for its riders, but those rules cannot override these terms.
The service we provide
FetchExpress is a platform that connects customers who need something fetched, delivered, or done with independent riders who can do it, and with merchants who supply goods. We provide the technology to post a request, choose a rider, communicate, track the order, and arrange payment. We are a marketplace and facilitator. We do not ourselves buy the goods, perform the errands, or employ the riders, and we are not a party to the underlying transaction between you and the other member.
Your account
You must give accurate information when you register and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure. You must be old enough under Philippine law to enter into a binding agreement. We may suspend or close accounts that breach these terms, are used unlawfully, or put the safety of the community at risk.
Responsibilities of customers, riders, and merchants
Customers must describe what they need honestly, pay the agreed amount, and treat riders with respect. Riders are independent providers who must fulfill accepted orders in good faith, follow the law and road rules, and handle goods and cash responsibly. Merchants must list accurate products and prices and supply what was ordered. Every member must communicate honestly and must not arrange to settle FetchExpress orders off-platform to avoid these terms.
Payments and cash on delivery
Prices, item costs, delivery fees, and any service charges are shown before you confirm an order. Cash on delivery means you pay the rider in cash when the order arrives, for the item cost plus the agreed fees. You agree to pay the full amount due on delivery. Where electronic payment is offered, it is processed by our third-party payment provider under their terms. Refunds, cancellations, and disputes over amounts are handled under our cancellation and refund rules, which form part of these terms.
Cancellations and refunds
You may cancel an order before a rider has acted on it without charge. Once a rider has begun work or purchased items, cancellation may incur a charge to cover costs already paid by the rider. If an order is not delivered as agreed, contact us and we will review the case fairly. Detailed cancellation windows and refund handling are set out in our cancellation policy.
Disclaimers and limitation of liability
FetchExpress is provided on an "as is" and "as available" basis. We do not guarantee that a rider will accept any order, that the service will be uninterrupted, or that goods supplied by merchants or third parties will meet your expectations. To the fullest extent permitted by Philippine law, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees we earned on the order giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
Dispute resolution
If you have a problem with an order, raise it with us first through the contact channel below and we will try to resolve it promptly and fairly. If a dispute cannot be resolved informally, the parties will seek to settle it amicably before pursuing any formal remedy, in accordance with applicable Philippine law.
Governing law
These terms are governed by the laws of the Republic of the Philippines, and any dispute relating to them or to the service is subject to the jurisdiction of the competent courts of the Philippines.
Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the effective date and, where appropriate, notify you. Continuing to use FetchExpress after a change means you accept the updated terms.
Acceptable use
Use FetchExpress lawfully and respectfully. Do not misuse the platform, attempt to defraud other members, post prohibited or unlawful items for fetching, harass or endanger riders, customers, or merchants, interfere with the service, or use it for any purpose that breaks the law.
